    The U.S. Commodity Futures Trading Commission (CFTC) has made significant strides in the world of cryptocurrency by updating its guidance regarding tokenized assets. This development, announced on Thursday, aims to provide derivatives firms with a clearer understanding of how they can engage with these digital representations of traditional assets, essentially allowing them to invest customer funds in tokenized versions of assets currently permitted under existing regulations.

    According to the CFTC, these tokenized assets must deliver legal and economic rights that are equivalent to those associated with their traditional counterparts. This stipulation ensures that while firms explore innovative blockchain solutions, they remain anchored to the established legal frameworks governing asset ownership.

    Furthermore, the CFTC emphasized that firms must adhere to stringent custody and customer fund protection requirements when holding tokenized assets. Importantly, this update does not create a new asset class but rather clarifies how existing rules apply to assets transitioning onto blockchain networks.

    Blockchain Records Gain Regulatory Recognition

    In a noteworthy addition, the agency has also recognized the potential of blockchain technology for recordkeeping purposes. The guidance now states that regulated entities may utilize blockchain or distributed ledger systems for creating and maintaining essential records. This aligns with the CFTC’s overarching rules that mandate firms to preserve transaction and regulatory data.

    Interestingly, the CFTC’s recent proposal for crypto market rules has also been sent for White House review, further solidifying the regulatory framework surrounding digital assets. The guidance delineates that while private networks can function as the primary record systems without the need for off-chain copies, public networks must implement backup controls to ensure that records remain accessible during emergencies or network disruptions.

    CFTC Action Follows Senate Setback

    This timely update comes on the heels of the Senate’s failure to advance the Digital Asset Market Clarity Act, which aimed to establish a federal framework for digital assets and proposed expanding the CFTC’s authority over crypto spot markets. Despite recent discussions about the potential revival of the CLARITY Act, the setback has left regulatory agencies to continue their work within existing powers.

    The CFTC has remained proactive, issuing guidance, no-action positions, and policy updates for the evolving landscape of crypto markets. Notably, the agency recently provided relief to certain software providers from the necessity of introducing broker registration under specified conditions.

    Crypto Policy Work Continues

    Chairman Michael S. Selig expressed that the updated guidance seeks to furnish the crypto industry with clearer regulatory direction. This latest set of FAQs builds upon earlier guidance from March 2026, which addressed tokenized collateral, margin assets, and recordkeeping protocols.

    As regulated entities continue to explore on-chain derivatives and other blockchain products under CFTC oversight, this guidance reiterates the importance of maintaining core compliance duties. Firms must ensure proper custody, reliable records, and effective systems that can withstand disruptions. Ultimately, the CFTC’s focus remains on whether the digital form of tokenized assets retains the rights associated with traditional assets, laying the groundwork for a more integrated and secure crypto market.
