Tokenized Stocks: U.S. Companies Push Back Against OKXICE Initiative

In a recent development that has sent ripples through the crypto and equity markets, nine U.S.-listed companies have formally objected to the trading of tokenized versions of their shares on OKXICE, a burgeoning joint venture between crypto exchange OKX and the Intercontinental Exchange (ICE), parent of the New York Stock Exchange (NYSE).

This significant pushback has resulted in the exclusion of approximately 14% of the 63 stocks initially set to be offered on the platform. Among those voicing their concerns are notable firms like CoreWeave ($CRWV), Broadcom, and Verizon, alongside entities such as UnitedHealth Group and Applied Optoelectronics.

The objections were primarily driven by uncertainty regarding the impact of tokenization on factors such as pricing, liquidity, and volatility. A spokesperson for Applied Optoelectronics stated that the company did not perceive a clear benefit for its shareholders, emphasizing the need for caution in embracing such a novel framework.

Interestingly, eight of the nine companies objecting were part of the original list of 63 stocks mentioned by OKXICE on October 4, with Cerebras Systems being the only exception. Despite these setbacks, OKXICE officials remain optimistic, asserting that they still plan to offer a wide array of stocks, including high-profile names like Nvidia, Apple, Microsoft, Amazon, Alphabet, Tesla, JPMorgan Chase, and Walmart.

    Understanding the Objections

As the objections unfolded, it became evident that concerns were rooted in the unfamiliarity of the tokenization process. Specifically, Applied Optoelectronics articulated worries about the lack of clarity regarding how tokenization would affect stock pricing and market dynamics. The company, along with others, expressed a reluctance to endorse a trading method that they felt was still unproven.

While the remaining eight companies did not provide immediate comments on their objections, it’s evident that caution is a prevailing sentiment in the corporate world. Notably, Nasdaq has also opted out of having its own shares tokenized under the SEC’s framework, voicing concerns about the lack of real-time price displays and comprehensive reporting.

Andrew Cuomo, co-chair of OKXICE, anticipated these objections, suggesting that some companies would choose to engage while others prefer to observe from the sidelines.

    How the SEC Framework Works

The SEC introduced a five-year innovation exemption on September 17, allowing tokenized securities venues to trade tokenized versions of U.S.-listed stocks without needing to register as traditional exchanges. Under this framework, when a third party tokenizes a stock, the venue must notify the respective company at least 30 days before trading commences, allowing the company a similar window to file an objection.

Should a timely objection be raised, the venue cannot proceed with the token offering; however, silence indicates that the listing may move forward, starting a new 30-day countdown for each new venue involved.

In terms of technological implementation, OKXICE plans to utilize permissioned liquidity pools on X Layer, a layer-2 network. Each tokenized stock will be paired against stablecoins like USDC, USDG, or USDT, with strict identity and sanctions checks in place for traders. Although the launch date remains unspecified, the intention to create a secure trading environment is clear.

In the broader context, the market for tokenized stocks has seen substantial growth, valued at around $3.5 billion as of mid-October, a significant leap from approximately $680 million at the start of the year.

As the landscape of tokenized equities continues to evolve, the reservations expressed by these companies reflect broader apprehensions about the integration of traditional finance with digital assets. Stakeholders in both arenas will be watching closely to see how this story unfolds in the coming months.
